  5. Expert Witness & Dispute Resolution

In construction disputes, technical evidence is often the deciding factor between winning and losing. At Pro Inspect Solution, we provide independent Expert Witness services to support legal teams, property owners, and contractors in litigation, arbitration, and CIPAA adjudications. Combining academic rigor with practical engineering experience, we deliver unbiased, forensic analysis of construction defects, contract breaches, and structural failures that stands up to scrutiny in Malaysian courts.

When Do You Need an Expert Witness?

Standard inspection reports are often insufficient for legal proceedings. You need an “Expert Report” compliant with Order 40A of the Rules of Court 2012 when dealing with:

  • Defective Workmanship Claims: Proving that a contractor failed to meet the specifications or Good Industry Practice.

  • Renovation Disputes: Homeowners suing contractors for unfinished or substandard renovations.

  • Damage from Neighboring Construction: Proving causation (e.g., “Did the piling next door cause these cracks?”).

  • CIPAA Payment Disputes: Technical assessment of work done vs. claimed amounts for payment adjudication.

  • Personal Injury Cases: Determining if a building defect (e.g., slippery floor, collapsed ceiling) caused an injury.

Root Cause Analysis

We don't just say "it cracked." We use scientific methods to determine why it cracked—was it design error, material failure, or external force?

Quantum of Rectification

We provide detailed cost estimates for the necessary repairs, giving the court a clear monetary figure for damages.

Scott Schedule Preparation

We assist lawyers in drafting the Scott Schedule (a table comparing the plaintiff’s claim vs. the defendant’s response) for efficient legal arguments.

Expert Witness FAQs

Common questions from owners, contractors and legal teams

What does an engineering expert witness do?

An expert witness investigates the technical issues in a dispute, such as defects, their causes and the cost of rectification, and gives an independent opinion in a report and, if needed, in testimony.

What is Order 40A of the Rules of Court 2012?

Order 40A deals with expert evidence in Malaysian courts. It says an expert's duty is to assist the court on matters within their expertise, and this duty overrides any obligation to the party who appoints or pays them. It also sets out what an expert report must contain.

What kinds of disputes do you handle?

Defective workmanship claims, renovation disputes, damage from neighbouring construction, CIPAA payment disputes and injury cases involving building defects.

Can you help before we start legal action?

Yes. A preliminary technical opinion reviews the documents and the site and gives you an honest view of the technical merits before you commit to proceedings.

Can an ordinary inspection report be used as expert evidence?

Often it is not enough. An expert report sets out the chronology, the standards relied on, the evidence and test results, and the reasoning behind each opinion.
